4. Filing a DMCA Takedown Notice

5. Processing of Takedown Notices

Upon receipt of a fully compliant DMCA Takedown Notice, our Designated Copyright Agent will initiate the following process:

  • We will conduct a prompt internal review of the specific URL(s) and materials cited in the notice.
  • If the notice meets all legal requirements, we will expeditiously remove or disable access to the allegedly infringing content.
  • We will make a reasonable, good-faith effort to contact the individual or contributor who originally uploaded or provided the targeted content, informing them of the takedown and providing them with a copy of the DMCA notice.
  • We reserve the right to preserve a copy of the removed material for legal and administrative purposes.

6. Filing a DMCA Counter-Notice

If you believe that your content was removed (or to which access was disabled) by mistake or misidentification, and you possess the legal right to use and distribute the material, you may file a DMCA Counter-Notice. To be legally valid, your Counter-Notice must be a written communication sent to our Designated Copyright Agent and must include the following information:

  1. Physical or Electronic Signature: Your physical or electronic signature.

7. Processing of Counter-Notices

Upon receiving a valid Counter-Notice, our Designated Copyright Agent will promptly forward a copy of it to the original complaining party. We will inform the complaining party that we may replace the removed material or cease disabling access to it within ten (10) to fourteen (14) business days.

Unless the original complaining party notifies our Designated Copyright Agent that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our platform, the removed material may be restored, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our sole discretion.

8. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, uae.namebangla.com has adopted a strict policy of terminating, in appropriate circumstances and at our sole discretion, the access privileges or accounts of contributors, users, or authors who are deemed to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had infringing submissions removed from our platform more than twice.
